Welcome to Eclat Fete, Canada's premier party planning and event organization service. These Terms of Service ("Terms") govern your use of our website, services, and any related applications or platforms operated by Eclat Fete ("we," "us," or "our"). By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services.
These Terms constitute a legally binding agreement between you and Eclat Fete. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting on our website. Your continued use of our services after any modifications constitutes your acceptance of the revised Terms.
2. Service Description
Eclat Fete provides comprehensive party planning and event organization services across Canada, including but not limited to:

- Vendor coordination and management
- Timeline development and event execution

- Post-event cleanup and breakdown services

3. User Responsibilities
As a user of our services, you agree to:
- Provide accurate and complete information when booking our services
- Communicate your event requirements clearly and in a timely manner
- Make payments according to the agreed schedule and terms
- Respect our staff, vendors, and venue policies during events
- Notify us immediately of any changes to event details or requirements
- Comply with all applicable laws and regulations during events
- Obtain necessary permits and permissions for your event if required
You are responsible for ensuring that all guests at your event comply with venue rules, local laws, and these Terms. Any damages or additional costs resulting from non-compliance will be your responsibility.
4. Payment Terms and Cancellation Policy
Payment for our services is typically structured as follows:
- Initial consultation: Free of charge for the first meeting
- Booking deposit: 25% of total service cost required to secure your event date
- Progress payment: 50% due 30 days before the event
- Final payment: Remaining balance due 7 days before the event
Cancellation policy:
- More than 60 days before event: 75% refund of payments made
- 30-60 days before event: 50% refund of payments made
- 15-30 days before event: 25% refund of payments made
- Less than 15 days before event: No refund available
All refunds will be processed within 14 business days of cancellation confirmation. Vendor deposits and non-refundable expenses may not be refundable regardless of cancellation timing.
5. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Eclat Fete or our content suppliers and is protected by Canadian and international copyright laws. You may not reproduce, distribute, or create derivative works from our content without express written permission.
Event designs, themes, and creative concepts developed by Eclat Fete remain our intellectual property. However, you have the right to use these designs for your specific event. We may use photos and descriptions of your event for marketing purposes unless you specifically opt out in writing.
Any feedback, suggestions, or ideas you provide to us may be used by Eclat Fete without compensation or attribution, unless otherwise agreed upon in writing.
6. Limitation of Liability
Eclat Fete's liability is limited to the total amount paid for our services. We are not liable for:
- Indirect, incidental, or consequential damages
- Acts of nature, weather conditions, or force majeure events
- Vendor failures or third-party service issues beyond our control
- Venue-related problems or restrictions
- Guest behavior or actions during events
- Personal injury or property damage not directly caused by our negligence
We strongly recommend that clients obtain appropriate event insurance to cover potential damages, cancellations, or unforeseen circumstances. We maintain professional liability insurance but encourage clients to verify coverage adequacy for their specific needs.
7. Privacy and Data Protection
We are committed to protecting your privacy and personal information. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our services, you consent to our privacy practices as described in our Privacy Policy.
We may collect personal information including but not limited to names, contact information, event preferences, and payment details. This information is used solely for the purpose of providing our services and improving customer experience.
We do not sell, rent, or share your personal information with third parties except as necessary to provide our services or as required by law. All data is stored securely and in compliance with applicable Canadian privacy legislation.
8. Force Majeure
Neither party shall be liable for any failure or delay in performance under these Terms which is due to an event of Force Majeure. "Force Majeure" means any circumstances beyond the reasonable control of either party, including but not limited to:
- Natural disasters, severe weather conditions, or environmental emergencies
- Government actions, regulations, or public health orders
- War, terrorism, or civil unrest
- Labor strikes or disputes affecting essential services
- Pandemic conditions or public health emergencies
- Venue closures or capacity restrictions beyond our control
In the event of Force Majeure, we will work with you to reschedule your event or provide alternative solutions. If rescheduling is not possible, refunds will be provided according to our cancellation policy, minus any non-recoverable expenses.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Canada and the province in which services are provided. Any disputes arising from these Terms or our services shall be resolved through binding arbitration or in the courts of competent jurisdiction in Canada.
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
